Practice Experience
Amy L. Kashiwabara is Of Counsel with Access International Law Group. She has over eight years of experience representing clients in international and domestic business litigation, and assists companies with disputes arising out of contracts and business torts, including matters involving unfair competition, intellectual property, employment, securities, and antitrust. She has extensive experience representing both plaintiff and defendant companies in federal and state courts, and has successfully served as lead trial counsel in a federal jury trial. She also represents businesses in informal and alternative dispute resolutions.
Prior to joining Access International Law Group, Ms. Kashiwabara was a Senior Associate in the San Francisco office of Folger Levin & Kahn LLP, focused on complex commercial litigation. Ms. Kashiwabara has represented companies, domestic and international, large and small, in disputes ranging from breach of contract to complex antitrust claims involving billions of dollars in purchases worldwide. Ms. Kashiwabara has counseled clients in the United States, Europe, and Asia with respect to disputes involving a range of industries, including telecommunications, manufacturing, consumer services, high technology, and biotechnology.
Ms. Kashiwabara has appeared in arbitrations before the American Arbitration Association, JAMS and the Financial Industry Regulatory Authroity.
Representative matters include:
- Represented a major computer manufacturer in pursuing global antitrust price-fixing claims against suppliers of computer components.
- Obtained a favorable jury verdict as lead trial counsel in federal lawsuit involving breach of contract claims. The Ninth Circuit Court of Appeals affirmed the judgment, which awarded the client all damages and attorneys’ fees sought.
- Defended CardioNet, a heart-monitoring company, against patent infringement claims asserted in the Western District of Pennsylvania.
- Defended class actions brought by students against the UC Regents for breach of contract with regard to student fees. Successfully opposed a motion for statutory attorneys’ fees under Code of Civil Procedure 1021.5.
- Represented PeopleSoft in unfair competition litigation against Oracle arising from Oracle’s hostile tender offer.
- Defended class action lawsuits alleging deceptive and unfair business practices in several states related to rental car agreements. Opposed motions for attorneys’ fees and obtained a very favorable published opinion from the New Jersey Appellate Division.
